Please carefully read this document before signing. This document contains a release of liability and a waiver of certain legal rights.

 

In exchange for participation in the activities organized by HRG, and/or use of the property, facilities and services of HRG, I agree on behalf of myself and (if applicable)on behalf of all minors for whom I am parent or guardian, to the following:

 

1. AGREEMENT TO FOLLOW DIRECTIONS. I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by HRG, or the employees, representatives or agents of HRG.

 

2. ASSUMPTION OF THE RISKS AND RELEASE. I understand that there are certain inherent risks, hazards and dangers associated with the above described activity and I assume full responsibility for personal injury to myself and (if applicable)minors for whom I am parent or guardian, and further release and discharge HRG,its owners, agents, representatives and employees for injury, loss or damage arising out of my, or my family’s use of or presence upon facilities of HRG, whether caused by the fault of myself, my family, HRG, or other third parties.I am voluntarily participating in these activities and am using the services of HRG with the full knowledge of the risks involved. I accept and assume all risks of the activities and services, known or unknown, foreseeable or unforeseen.

 

3.INDEMNIFICATION. I agree to indemnify and defend HRG against all claims, causes of action, damages,judgements, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my or minors (for whom I am parent or guardian)’s use of or presence upon the facilities of HRG.

 

4. FEES. I agree to pay for all damages to the facilities of HRG caused by any negligent, reckless or willful actions by me or minors for whom I am parent or guardian.

 

5.PHOTO RELEASE. By participating in the activities offered by HRG, I hereby grant HRG on behalf of myself and on behalf of minors for whom I am parent or guardian, the irrevocable right and permission to photograph and/or record me and/ or minors for whom I am parent or guardian in connection with HRG and to use the photograph and/or recording for all purposes, including advertising and promotional purposes, in any manner and all media now or hereafter known, in perpetuity throughout the world, without restriction as to alteration. I waive any right to inspect or approve the use of the photograph and/or recording, and acknowledge and agree that the rights granted to this release are without compensation of any kind.

 

6.NO DURESS. I agree and acknowledge that I am under no pressure or duress to sign this Agreement and that I have been a reasonable opportunity to review it before signing. I further agree and acknowledge that HRG has offered to refund any fees I have paid to use its facilities should I choose not to sign this agreement
